A Time To Shop respects copyright. We write our own articles, we license or take our own images where we can, and we use third-party product images and short quotations for identification and commentary. If you own a work and believe it appears on atimetoshop.com without permission, this page tells you how to have it removed.

Send us a notice

Under the Digital Millennium Copyright Act, a notice must be in writing and must include all of the following. A notice missing any of them may not be actionable, so please include everything:

  1. your physical or electronic signature;
  2. identification of the copyrighted work you say has been infringed, or, if a single notice covers several works on this site, a representative list of them;
  3. identification of the material you say is infringing, with enough detail for us to find it. A direct URL on this site is the most useful thing you can give us;
  4. your name, mailing address, telephone number and email address, so we can reach you;
  5. a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  6. a statement that the information in the notice is accurate and that, under penalty of perjury, you are the copyright owner or are authorised to act on the owner's behalf.

Written notices:

Please put “DMCA Notice” in the subject line. Notices sent to any other address may be delayed.

What we do when we receive one

  • We review the notice and, where it is complete and appears valid, remove or disable the material expeditiously.
  • We tell whoever supplied the material that it has been removed, and pass on the notice.
  • We do not need to agree with a notice to act on it, and taking material down is not an admission that it infringed.
  • Where the material is a product image supplied by a manufacturer or an affiliate network, we will also tell you where we obtained it, because that is often the faster route to the source of the problem.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice. It must include:

  1. your physical or electronic signature;
  2. identification of the material that was removed, and the location where it appeared before removal;
  3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is located, or, if your address is outside the United States, for any district in which we may be found, and that you will accept service of process from the person who gave the original notice.

We will forward a valid counter-notice to the person who sent the original notice. If they do not tell us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.

False claims cut both ways

Section 512(f) makes a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, liable for damages and costs. Do not use this process to remove criticism, a comparison, or a review you dislike. Naming a product, quoting a specification and publishing an unfavourable opinion is not copyright infringement.

Repeat infringers

We will remove material from, and where appropriate block, any contributor who is the subject of repeated valid copyright notices.

Our articles, photography, layout and code are protected too. What you may and may not do with them is in our terms of use. If you would like to license or republish something of ours, ask us at filone@atimetoshop.com rather than assuming.
